Medical Assistance In Dying (MAID)

Background

In February 2015, the Supreme Court of Canada ruled in Carter v. Canada that parts of the Criminal Code would need to change to satisfy the Canadian Charter of Rights and Freedoms. The parts that prohibited medical assistance in dying (MAID) would no longer be valid. MAID became legalized in Canada in 2016 allowing those that meet the eligibility criteria to seek out medical assisted suicide.

To be considered eligible for MAID, a patient must:

  • be eligible for publicly funded health care services in Canada
  • be 18 years of age or older
  • be capable of making health care decisions
  • have a grievous and irremediable medical condition
